Privacy Notice and Protection of Personal Data:

This website collects certain Personal Data from its Users. This page describes how the website is managed with regard to the processing of personal data of users who access it.

This notice is provided, in compliance with Articles 13 and 14 of EU Regulation 679/2016 (hereinafter, the “Regulation”), to users (hereinafter: “Users” or “User”) of this website and any related mobile application (hereinafter: “Site and App”), owned by Hotvision LTD, the Data Controller (hereinafter: the “Controller”), and aims to describe how the Site and App are managed in relation to personal data processing, and to allow Users of the Site and App to understand the purposes and methods of processing their personal data by the Controller, should they choose to provide it.

As specified in the Terms and Conditions of the service, the services offered by the Controller are intended for individuals over 18 years of age. Should the Controller become aware of the processing of data belonging to minors under the age of 18 without valid parental or legal guardian consent, it reserves the right to unilaterally terminate the provision of the service and delete the acquired data.

Terms not defined in this Privacy Notice have the same meaning as those described in the section titled “General Conditions and Terms of Service.”

This notice applies only to this website and not to any other websites that may be accessed by the user through links.

The Controller, for the purposes and effects of the Regulation, informs that the aforementioned regulation provides for the protection of natural persons regarding the processing of personal data, and that such processing will be based on principles of fairness, lawfulness, transparency, and the protection of confidentiality and fundamental rights.

Purposes, Legal Basis of Processing, and Optional Provision of Data:

The personal data collected by the Controller through the use of the Site and App will be processed, with the consent of the data subjects, for the following purposes:

  • To allow users and visitors of this website to request a quote for the chosen service and be connected with available professionals and partner companies, and to evaluate the offer and quotes received;

  • To allow professionals and partner companies to receive quote requests submitted by users and to send them the requested quotes, contact them by phone to provide further information, and to sell their advertised products and services as per the user's request;

  • To provide Users with industry-related information and commercial promotions of products and services distributed by the Controller or third-party companies (including through automated processes such as profiling). Such information may be provided to the User electronically (via email, SMS, MMS), in printed form, or through direct contact with a sales representative;

  • To allow Users to publish reviews.

For the purposes mentioned above, the Controller applies, as the legal basis for processing, the necessity to process personal data for the execution of the Contract, particularly to ensure complete management of the request and quote process and selection of the Professional or partner company providing the service. This requires the express consent of the data subject for one or more specific purposes, pursuant to Article 6, letter a) of the Regulation.

The provision of data for the above purposes is therefore strictly necessary to properly manage the process of joining the commercial offer of the partner company, selecting the professional, and accepting the proposed quote.

Types of Data Collected:

Among the Personal Data collected by this website, either independently or through third parties, are: Cookies, Usage Data, First Name, Last Name, Phone Number, and Email.

Other Personal Data collected may be indicated in other sections of this privacy policy or through specific informational texts displayed at the time the Data is collected.

Personal Data may be provided voluntarily by the User, or, in the case of Usage Data, collected automatically during the use of this website.

Any use of Cookies – or other tracking tools – by this website or by third-party service providers used by this website (unless otherwise specified) is intended to identify the User and record their preferences for purposes strictly related to the provision of the service requested by the User.

Failure by the User to provide certain Personal Data may make it impossible for this website to provide its services.

The User assumes responsibility for the Personal Data of third parties published or shared through this website and declares to have the right to communicate or disseminate them, releasing the Controller from any liability towards third parties.

Methods, Places, and Timing of Data Processing:

The Controller processes the Users’ Personal Data by adopting appropriate security measures to prevent unauthorized access, disclosure, modification, or destruction of Personal Data.

The processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the purposes indicated. In addition to the Controller, in some cases, other categories of personnel involved in the organization of the website (such as administrative, sales, marketing, legal, and system administration staff) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communication agencies) may have access to the Data. These parties may also be appointed, if necessary, as Data Processors by the Controller. An updated list of Data Processors can always be requested from the Data Controller.

The Controller ensures that the personal data is processed in full compliance with the Regulation, in paper and/or electronic format, possibly using automated procedures. Processing may also be carried out through automated tools capable of storing, managing, and transmitting the data.

Collected and processed data will be protected using physical and logical methods that minimize the risk of unauthorized access, dissemination, loss, and destruction of data, in accordance with Articles 25 and 32 of the Regulation.

The data will be retained for no longer than is necessary to fulfill the purposes for which they were collected.

Pursuant to Article 7, paragraph 3 of the Regulation, the data subject may, at any time and in a simple and quick manner, revoke consent to the processing and request the deletion of their personal data by sending a communication to the Controller at: marketing@hotvisiondigital.com

Upon the User’s request for deletion, all of their personal data will be deleted, except for any retention required by legal obligations. Furthermore, if the User has been flagged, suspended, or sanctioned for fraudulent or suspicious behavior, or if a User requests deletion after submitting a request or review, the Controller reserves the right to retain personal data relating to that User for a period of 2 (two) years from the deletion request, in order to prevent the occurrence and/or recurrence of potential fraud against the Controller.

If no deletion request is received by the Controller, the personal data will be retained for no longer than 10 (ten) years, starting from the date of the User’s last access to the Site and/or App.

The Data is processed at the operational offices of the Controller and in any other place where the parties involved in the processing are located. For further information, please contact the Controller.

Recipients of Collected Personal Data:

User data is collected to allow the Data Controller to provide its services, as well as for the following purposes: statistics, SPAM protection, and contacting the User for matters related to the services or products advertised on this website.

The personal data collected may be processed by persons or categories of persons who act as Data Processors pursuant to Article 28 of the Regulation or who are authorized to process data pursuant to Article 29 of the Regulation.

Furthermore, for certain services, the data may be communicated to companies that collaborate with or use the Controller’s services—such as professionals who offer their services through the Site and App, or other companies (hereinafter “Partners”)—with the sole purpose of delivering the services requested by the User. In such cases, Partners are independent data controllers and, therefore, the Controller and Data Processor of this website is not responsible for how those third parties process the data. Additionally, the Controller is not responsible for the content or compliance with data protection regulations by websites not managed by the Controller.

Specifically, the data provided by the User may be shared by the Controller with the following third parties, exclusively for the purpose of delivering the services requested by the User or fulfilling other legal obligations:

  • Service companies used by the Controller to manage User data on its behalf for purposes such as sending SMS and notification messages related to services offered, verifying the accuracy of the email address provided at registration, statistical analysis, use of marketing platforms, IT services for data storage, and customer support;
  • Commercial partners and marketing service/tool providers with whom the Controller shares some of the User’s data solely for marketing and promotional purposes related to the services and advertised products.

Outside of the above cases, personal data will not be shared except with entities, authorities, or organizations to which communication is required by law or regulation.

The types of Personal Data used for each purpose are described in the specific sections of this document.

Personal data collected through the Site and App may be transferred outside the national territory solely for the execution of services requested through the Site and App, and in compliance with the provisions of the Regulation.

Some personal data may be shared with recipients located outside the European Economic Area. The Controller ensures that the processing of personal data by these recipients is done in compliance with the Regulation.

This data may be used by the Controller to obtain anonymous statistical information on the usage of the Site and App, in order to identify the most visited pages and improve content relevance, as well as to verify correct site operation. It may also be used, with the User’s explicit consent, to send communications and reminders (e.g., callback requests).

At the request of legal authorities, this data may also be used to determine responsibility in the case of potential cybercrimes against the Site and App or its Users.
